Agreement to Terms

All services are subject to availability and may vary based on location, equipment, and specific customer needs.
Scheduling and Appointments
- Service appointments must be scheduled in advance by phone, email, or through our website contact form.
- We will make reasonable efforts to arrive within the scheduled time window, but delays may occur due to unforeseen circumstances.
- Customers must provide accurate property information and ensure access to the service location at the scheduled time.
- Rescheduling or cancellation must be done at least 24 hours in advance to avoid cancellation fees.
Pricing and Payment
Service Fees
- All prices are quoted in U.S. Dollars and are subject to change without notice.
- Diagnostic fees, service call fees, and labor rates will be communicated before service begins.
- Final costs may vary based on the actual work performed, parts required, and time spent on-site.
- Written estimates are provided for major installations and repairs.
Payment Terms
- Payment is due upon completion of services unless other arrangements have been made in advance.
- We accept cash, checks, and major credit cards.
- For large installations, a deposit may be required before work begins, with the balance due upon completion.
- Late payments may be subject to interest charges and collection fees.
Warranties and Guarantees
Workmanship Warranty
We guarantee our workmanship for a period of one (1) year from the date of service completion. If any issues arise due to our installation or repair work within this period, we will correct them at no additional charge.
Equipment Warranties
New equipment comes with manufacturer warranties, which vary by brand and product. We will provide warranty information at the time of purchase and assist with warranty claims as needed.
Warranty Limitations
Warranties do not cover damage caused by misuse, neglect, accidents, unauthorized modifications, or failure to perform recommended maintenance. Warranties are void if repairs are attempted by unauthorized parties.
Customer Responsibilities
As a customer, you agree to:
- Provide accurate information about your HVAC system and property
- Ensure safe and clear access to equipment and work areas
- Disclose any known hazards or special conditions (asbestos, mold, etc.)
- Be present or designate an authorized representative during service visits
- Follow maintenance recommendations to ensure optimal system performance
- Notify us immediately of any concerns or issues with completed work
Limitation of Liability
To the fullest extent permitted by law:
- Our liability for any claim arising from our services is limited to the amount paid for those specific services.
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, business interruption, or property damage beyond our direct control.
- We are not responsible for pre-existing conditions, code violations, or hidden defects not discovered during our inspection.
- We maintain appropriate insurance coverage, and claims may be subject to insurance policy terms and limits.
Emergency Services
Emergency services are available outside of regular business hours for urgent HVAC issues. Emergency service rates apply and are higher than standard rates due to the immediate response required. Emergency service does not guarantee same-day repair completion, as parts availability and complexity of repairs may require follow-up visits.
Permits and Compliance
When required, we will obtain necessary permits for HVAC installations and major repairs. All work is performed in accordance with local building codes and regulations. Customers are responsible for ensuring that any work performed complies with homeowners association rules or rental property restrictions.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of OK Heating and Air Conditioning Inc. or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Dispute Resolution
In the event of a dispute:
- We encourage customers to contact us directly to resolve any concerns informally.
- If informal resolution is not successful, disputes may be submitted to mediation before pursuing legal action.
- Any legal proceedings will be governed by the laws of the State of California and venue will be in Alameda County.
Termination of Services
We reserve the right to refuse or terminate services if: payment is not received as agreed, the customer engages in abusive or threatening behavior toward our staff, unsafe working conditions exist, or the customer violates these Terms and Conditions.
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
